Chestermere’s Legal Setback: Court Dismisses Bid Against Council Dismissal

The Court of King’s Bench in Alberta rejected the City of Chestermere’s request to stop the Alberta government from dismissing the city’s council and top administrators. Justice Keith Yamauchi dismissed the injunction application against Municipal Affairs Minister Ric McIver’s planned dismissal order. Chestermere had sought this injunction while challenging a municipal inspection ordered in May 2022. The judge ruled that the harm to the public and the city would be greater than any harm to the applicants if the injunction was granted. The city’s lawyer, Jeff Moroz, is considering an appeal and a judicial review if the dismissal goes ahead. The decision follows a year-long conflict between Chestermere and the province over governance issues and the city’s failure to comply with provincial directives. Chestermere’s council, despite some opposition within, has been supporting and funding its legal battles against the province.
